В конце мая 2008 г. Госдума РФ приняла во втором чтении Закон «О концессионных соглашениях», который позволит бизнесу инвестировать средства в федеральное имущество, которое нельзя приватизировать. В бизнес среде давно ждали принятия этого законопроекта. Если документ пройдет в Совете Федерации, бизнес получит доступ к автодорогам, трубопроводам, аэродромам (в том числе взлетно-посадочным полосам), электростанциям и электросетям, железнодорожному и городскому транспорту, портам (включая причальные стенки), а также объектам коммунального хозяйства, культуры и здравоохранения. В этой ситуации особое значение приобретает критерий выбора победителей будущих конкурсов за инфраструктурные концессии. Автор статьи рассуждает о сложностях этого процесса, о «подводных камнях», которые ожидают будущих концессионеров, о причинах, по которым критерий максимума концессионной платы выбирается чиновниками в качестве критерия конкурса за концессию.

Bidding competitions organized to identify the winner that gains the right to conclude a concession agreement are one of the forms of competition for the best market share and are the most important stage of a concession project-related organizational process development. The experience gained in different countries of the world of organizing the concession bidding competitions in various infrastructure-related sectors (power supply, water supply, transportation services, etc.) is large but the experience has shown that the competition result is not always justified as the inadequate criteria are used when choosing the winner. The article author shows the reasons why the state officials choose the maximal concession payment as the only criterion that can identify the best concession competition bidder.
